Terms and Conditions

1. Agreement to terms

These Terms and Conditions ("Terms") govern access to and use of Scooper (the "Service"), operated by Scooper ("we," "us," or "our"). By creating an account, purchasing a package, or otherwise using the Service, you ("Customer," "you") agree to be bound by these Terms. If you are agreeing on behalf of a business, you represent that you have authority to bind that business.

2. The service

Scooper is a business-management platform for pooper-scooper and pet-waste-removal businesses, including scheduling, routing, GPS-based ETA notifications, invoicing, payment processing, and payroll-related tools. We may add, change, or remove features at any time.

3. Accounts & packages

Each business signs up for one of our published packages (Starter, Growth, or Pro), billed monthly or annually. Package tiers may include limits on the number of techs and/or clients; we may suspend or limit account functionality if those limits are exceeded without upgrading. You are responsible for keeping your account credentials confidential and for all activity under your account.

4. Billing & payment

Subscriptions are billed in advance on a recurring basis through our payment processor (Stripe) until canceled. Fees are non-refundable except where required by law. We may change package pricing on a going-forward basis with reasonable notice before your next billing cycle. Failure to pay may result in suspension or termination of access.

5. Cancellation

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate accounts for non-payment, violation of these Terms, or fraudulent/abusive use of the Service.

6. Customer data

You retain ownership of the client, job, and business data you submit to the Service ("Customer Data"). You grant us a license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for the accuracy of Customer Data and for having the right to share it with us, including any client contact information used for scheduling and ETA notifications.

7. Acceptable use

You agree not to use the Service to violate any law, send unsolicited communications, attempt to gain unauthorized access to other organizations' data, or interfere with the Service's normal operation. We may suspend accounts that violate this section.

8. Third-party services

The Service relies on third-party providers (including Stripe for payments, and mapping/notification providers for ETAs, email, and SMS). We are not responsible for outages or errors caused by these third parties, but we will make reasonable efforts to maintain functionality.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ESTIMATED ARRIVAL TIMES ARE CALCULATED FROM AVAILABLE LOCATION DATA AND ARE APPROXIMATE — WE DO NOT GUARANTEE THEIR ACCURACY. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOOPFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

11. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms here with a new "last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
